Foreclosure is the legal process by which a lender (bank, mortgage company, creditor, third-party lien holder) takes ownership of a property (usually a home) with the right to sell it, in order to repay a debt (the mortgage). Typically, three or four payments must be missed before the foreclosure notice is filed. Each state has its own laws that govern the proceedings, protecting the rights of both lender and debtor.
