Notice of Default - NOD


A notice of default or NOD is a part of the pre-foreclosure procedure, the first step in the foreclosure process. A NOD is the initial, non-judicial document given to a borrower by a trustee which states that the borrower has not made his or her payments by the predetermined deadline. A notice of default states that if the money owed (usually a legal fee is added onto this) is not paid in a given period of time, the lender may choose to foreclose the borrower’s property. Any other people who may be affected by the foreclosure may also receive a copy of the notification.
